RADIUS TERMS AND CONDITIONS

 1.0 Agreement

This Agreement is between RADIUS Art and “the ARTIST” for an exhibition of the ARTIST’s work at RADIUS Art.

2.0 Responsibilities of RADIUS Art

2.1 Exhibition costs will be charged for the full space ($950 for 4 weeks). For some group shows arranged by Radius and invitations to exhibit from Radius the space hire fees are waivered and a commission on sales might be negotiated on a case by case basis.

2.2 RADIUS will not staff exhibition and co-ordinate sales. Our Square Reader is available for sales with a 5% fee to cover costs.

2.3 RADIUS can help and design / print promotional materials including artist statements, invitations, price lists and key exhibition information.

2.4 RADIUS can distribute a press release for the exhibition based on supplied artist information supplied.

2.5 RADIUS will request written materials from the ARTIST including biography, works past and present, as well as the upcoming exhibition information.

2.6 RADIUS will design and distribute electronic exhibition invites to their digital network and to the supplied artist lists. Printed invitations are available at the artist request (printing costs apply, design is free of charge).

2.7 RADIUS will co-ordinate online and social network promotions and materials.

2.8 RADIUS will cover the design costs and co-ordination of advertising in print and/or related arts media at the ARTIST request, however the advertising fees are to be covered by the ARTIST.

6.6 RADIUS reserves the right to use images of artist’s work featured in the exhibition, provided by the ARTIST as well as images taken at Radius during the exhibition, for the sole purpose of promotion of the exhibition in print, online media, and related publications.

6.7 Copyright of all works remains at all times with the ARTIST. Full image credits will accompany all images. The intellectual property of the ARTIST will at all times be respected.

6.8 Installation will be undertaken by the artists.

3.0 Commission and Sales

3.1 Unless otherwise negotiated, all work in an exhibition must be available for sale. RADIUS will pay the artist for any works sold using our payment systems during the exhibit 30 days after the close of the exhibition.

3.2 The breakdown of funds is as follows:

•5% off final sales price for any artworks sold via our payment systems.

•RADIUS receives no commission on the final sales price from any artworks sold.

•If you are registered for GST you need to include 10% GST on your artworks and price to us accordingly.

3.3 All work in the exhibition must be available for sale through RADIUS for the duration of the exhibition.

3.4 If images of original works are editioned (ie prints) RADIUS must be notified prior to the editions going public.

3.5 Any works from the exhibition sold by the artist must be available for collection after the exhibition. Artist are to negotiate and arrange shipping of works to purchasors.

3.6 When artwork is consigned the retail price must be agreed upon and maintained by the artist in all other future sales/exhibitions of their work. Artwork cannot be sold for less than the market price advertised by RADIUS and agreed upon by the artist when consigning the work.

4.0 Liability

RADIUS accepts no responsibility for any physical injury or property loss or damage to the

exhibiting artists work, equipment or supplies in connection with this exhibition.

5.0 Invitations

5.1 Invitations are to be distributed jointly between the ARTIST and RADIUS.

5.2 The ARTIST is required to provide email addresses of people and organisations that they wish to be included within the promotions (see clause 2.6 above).

6.0 Disclosures

6.1 Transportation: The ARTIST assumes all responsibility for the safe transportation of all artwork, including insurance (if desired) in transit to and from RADIUS. Work may be hand-delivered to the Gallery or shipped directly.

6.2 The ARTIST undertakes that they are in a position to exhibit at RADIUS Gallery and are not represented elsewhere ensuring all clauses in Section 9 (Commission and Sales) can be honoured in full.

6.3 If the ARTIST fails to disclose any prohibiting representation, the ARTIST will be solely responsible for any costs incurred by RADIUS.

7.0 Insurance

7.1. RADIUS holds public liability coverage (RAV).

7.2 While all care is taken with artworks displayed at RADIUS, insurance against accidental damage and theft is the responsibility of the ARTIST.

7.3 The ARTIST assumes all risk for the loss or damage to his/her work during transportation prior to and after the exhibition.

8.0 De-installation

8.1 Exhibitors and event organisers will de-install their exhibition and leave the space as they found it.

8.2 Radius reserves the right to select works to retain for sale at RADIUS for the duration of 3 months after the completion of the exhibition.

9.0 Conduct and Responsibility at Events & Exhibitions

9.1 All artists, hirers, collaborators, contractors, crew members, and attendees using RADIUS Art Space are expected to behave in a respectful, lawful, and safe manner at all times.

9.2 RADIUS Art Space operates as a venue provider and is not responsible for the ongoing supervision, monitoring, or enforcement of individual behaviour during exhibitions, events, or associated activities.

9.3 Responsibility for the conduct of attendees, guests, collaborators, and invitees rests with the ARTIST, hirer, or event organiser engaging the space, including compliance with all applicable laws and regulations.

9.4 Any conduct that is unsafe, threatening, discriminatory, or unlawful is not tolerated. Matters involving serious misconduct, personal safety concerns, or potential criminal behaviour fall outside the remit of RADIUS Art Space and will be referred to the appropriate authorities rather than managed internally.

9.5 RADIUS Art Space reserves the right to withdraw access to the venue, cancel events, or refuse future bookings where behaviour is deemed to pose a risk to the safety, wellbeing, or comfort of others, or to the reputation and operation of the venue.

PLEASE FIND OUR ARTISTS CONTRACT BELOW. BY EXHIBITING WITH US YOU ACKNOWLEDGE THAT YOU HAVE READ OUR TERMS AND CONDITIONS ABOVE. IF YOU WOULD LIKE TO BE COVERED BY OUR PUBLIC LIABILITY INSURANCE POLICY WITH RAV (REGIONAL ARTS VICTORIA) TO ENSURE ANY INJURY RESULTING FROM YOUR ARTWORK TO THE PUBLIC IS COVERED YOU MUST SIGN THE ARTISTS CONTRACT BELOW. FAILURE TO SIGN WILL MEAN YOU ACCEPT LIABILITY OR HAVE YOUR OWN POLICY. ALL ARTISTS ARE EXPECTED TO HAVE THEIR ARTWORK COVERED BY THEIR OWN INSURANCE FOR DAMAGE, LIABILITY OR THEFT. OUR POLICY COVERS OUR STOCK.
